Goji Waiver & Terms and Conditions
- Introduction
Your use of our Website and our studio is subject to the following Terms and Conditions. We reserve the right to vary or amend these terms from time to time.
- Definitions
- “Class” means a session provided by or on behalf of Goji at its studio or online.
- “Class Pack” means a prepaid package that entitles a Client to a set number of Classes before expiry.
- “Client”: means any person who has booked into a class either online or in-studio, or with an active Class Pack.
- “Goji” means Zesa Limited, a company registered in England and Wales (Company No: 14658284), trading as Goji London.
- “Instructor” means a qualified, self-employed contractor leading a class.
- “Member” means a client with an active Membership Subscription.
- “Package” includes Class Packs, Monthly Memberships, and Unlimited Memberships.
- “Studio” means the Goji premises at 11 Old Town, Clapham, SW4 0JT, UK.
- “Website”: www.gojilondon.co.uk.
- Waiver & Release of Liability
Participation in Pilates, yoga, or fitness classes involves inherent risks. By signing this waiver, you accept responsibility for your own health and agree:
- You understand that Goji instructors are self-employed contractors and not employees of Goji.
- While Goji conducts reasonable due diligence on its instructors, including obtaining their qualifications, experience, and insurance, Goji is not responsible for any acts, omissions, negligence, or misconduct of instructors providing services at the studio.
- You recognise that Classes may require physical exertion and are aware of the risks and hazards involved. You will not exceed your personal exercise limits.
- You acknowledge that you are physically fit and have no medical condition which should prevent your full participation in a Class.
- You assume full responsibility for using any equipment provided.
- You acknowledge that classes may involve physical contact for posture adjustments and will inform instructors if you prefer otherwise.
- If you are pregnant, you acknowledge participation at your own risk and that non-pre-natal classes may not be suitable for your condition.
- You recognise that you will be sharing a room with other members of the public and potentially increasing the risk of contracting Covid-19 or other illnesses and are fully aware of this risk.
- I understand that Goji does not provide medical treatment or emergency medical assistance. In the event of a medical emergency, I authorise the studio to seek emergency medical services on my behalf if necessary. I understand that I am responsible for any associated medical costs.
- You waive any claims against Goji for injury or damages arising from participation.
4. Liability Disclaimer
- Goji does not provide medical treatment or emergency medical services.
- Goji is not responsible for any injury or harm caused by independent contractors providing services at its premises.
- You release Goji, its owners, directors, agents and instructors from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to my participation in Pilates, yoga, or any other activity offered by the studio.
- You agree to indemnify and hold harmless the studio, its owners, directors, agents and instructors, from any claims or liabilities to the fullest extent permitted by law
5. Right of Admission
Goji reserves the right to refuse entry or remove anyone whose conduct disrupts classes or breaches these Terms and Conditions, or if it would otherwise be in the interests of other customers.
- Membership & Class Packs
- Class Packs and Memberships are non-refundable, non-transferable, and must be used within the expiry period.
- Class Packs activate from the date of purchase. Expiry terms for each class can be viewed on our website. It is your responsibility to use your class pack within the required timeframe.
- Class packs are valid for use by named pass holders only.
- Memberships are rolling monthly contracts unless otherwise agreed in writing.
- A minimum 14-day notice is required for membership cancellations.
- Memberships can be paused for up to six weeks per year.
- Studio Policies
- Late Arrivals: If late, you may not be permitted entry to class. This is to preserve the environment for everyone and respect and minimise disruption for our teachers and the whole community.
- Cancellations & No-Shows:
- We have a strict 8-hour cancellation policy in order for your class credit to be returned. If you do not cancel before the 8-hour cancellation window, you will lose your class credit.
- If you are a monthly member, you may be subject to a penalty of £10 per late cancellation if you late cancel more than once a month.
- If you miss a class without cancelling, a ‘No Show’ fee of £10 will be charged.
- Valuables: Clients are responsible for their personal belongings. The studio does not have lockers and cannot guarantee the safety and security of your personal belongings.
- Check in: The studio requires that you sign into class prior to the class start time. It is your responsibility to ensure your attendance has been registered by the instructor. Failing to do so will mean you will be listed as a no-show.
- Payment & Pricing
- Payments are processed securely online only. Payments are not accepted in studio.
- Pricing and service availability may change without notice. Any changes affecting direct debit customers will be notified of any changes in advance.
- If an online booking is paid with a debit or credit card, you authorise Goji to charge the card provided by you without prior notice. These authorised charges may include, but are not limited to, fees for late cancellations, missed classes, penalties associated with monthly memberships, or any misuse of promotional offers, such as the Taster Intro Offer, which is strictly reserved for first-time clients. Any attempt to circumvent offer restrictions, including creating duplicate accounts or engaging in other fraudulent activity, will result in corrective charges to your card on file, and potential suspension of access to Goji services.
- Privacy & Data Protection
- We collect and store data to provide services and manage accounts.
- Data security measures are in place, but transmission risks exist. As with all information transmitted over the internet, security cannot be guaranteed. Any transmission is at your own risk. Once we have received your information, we will take reasonable precautions to prevent unauthorised access.
- If you contact us, we may keep a record of our correspondence, including but not limited to when you report a problem with the Website or the Momence App, provide feedback regarding any of our services, or apply for a job or volunteer position at Goji.
- Clients can amend or delete their data by contacting hello@gojilondon.co.uk.
- Promotions & Gift Cards
- Goji reserves the right to run promotional discounts and sale offers that may be varied at any point from time to time.
- Promotional discounts cannot be combined or backdated.
- Corporate discounts can be provided on request. For further information, contact us at hello@gojilondon.co.uk.
- Gift cards are valid for 3 months unless otherwise agreed in writing with the studio.
- Gift cards cannot be exchanged for cash, nor can any balances remaining be refunded.
- Independent Contractors
- All instructors, therapists, and service providers at Goji operate as independent contractors.
- Goji is not responsible for any loss, damage, injury, or claims arising from the actions or omissions of independent contractors.
- Any disputes regarding services provided by an instructor are to be settled directly with the instructor.
- Intellectual Property Rights
- You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
- You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
- You grant to us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use (including but not limited to publishing, exploiting and modifying) any material you email, post or submit to us. For the avoidance of doubt, we will be free to use any ideas, concepts, know-how, content, text or images contained in your communications with us for any purpose whatsoever, to the fullest extent permitted by law.
- Website Terms & Conditions
- Indemnity: You fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person
accessing the Website using your shopping account and/or your Personal Information. - We reserve the right to:
- Modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
- Change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions, then you must immediately stop using the Website.
- Compliance with laws: The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.
- Limitation of Liability:
- While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from a course of dealing or usage or trade.
- We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available is free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
- To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
- We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in
connection with the Conditions for: Any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or - Any loss of goodwill or reputation; or
- Any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.
- Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
- Severance
If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.
- Survival
Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
- Governing Law
These Terms and Conditions are governed by English law, and disputes shall be settled in English courts.
