Goji Waiver & Terms and Conditions

1.Introduction

Your use of our Website, booking platform, and attendance at any Goji studio is subject to the following Terms and Conditions.

By purchasing a class pack or membership, booking or attending a class, using our facilities, or accessing our Website, you agree to be bound by these Terms.

We reserve the right to vary or amend these Terms from time to time. The most current version will always be available on our Website.

2. Definitions

  • “Class” means a session provided by or on behalf of Goji at any Goji studio or online.
  • “Class Pack” means a prepaid package that entitles a Client to a set number of Classes before expiry.
  • “Client”: means any person who has booked into, or attended, a class either online or in-studio, or with a previous or current Class Pack or Membership.
  • Facilities” includes changing rooms, showers, lockers, infrared sauna facilities, recovery areas, reception areas and any ancillary amenities provided by Goji.
  • Goji” means the Goji-branded studios: Services may be provided by different Goji-affiliated operating entities depending on the studio location.
    • Zesa Limited (company number 14658284), trading as Goji London / Goji Pilates & Yoga Studio, operating the mat Pilates and yoga studio located at 11 Old Town, Clapham, London SW4 0JT; and/or
    • Feel Good Pilates Limited (company number 16251492), trading as Goji London / Goji Reformer Pilates, operating the reformer Pilates studio located at 53–55 Balham Hill, London SW12 9DR,
  • together with their respective directors, affiliates, contractors, agents and representatives, as applicable depending on the relevant studio location, booking, service or package purchased.
  •  “Infrared Sauna” means any sauna, recovery or heat-based wellness facility operated by Goji.
  • “Instructor” means a qualified, self-employed contractor providing services at a Goji studio.
  • “Member” means a client specifically with an active Membership Subscription.
  • “Package” includes Class Packs, Monthly Memberships, Intro Offers and other prepaid services.
  •  “Reformer Class” means any Pilates class involving the use of reformer machines or associated apparatus.
  • “Studio” means the Goji premises at 11 Old Town, Clapham, SW4 0JT, UK and 53-55 Balham Hill, London, SW12 9DR, UK.
  • Website”: www.gojilondon.co.uk.

3. Waiver & Release of Liability

Participation in Pilates, yoga, reformer Pilates, sauna use, or any fitness-related activity involves inherent risks. By attending Goji, you accept responsibility for your own health, and acknowledge and agree that:

  • You understand that Goji instructors are independent contractors and not employees of Goji.
  • While Goji conducts reasonable due diligence on its instructors, including obtaining their qualifications, experience, and insurance, Goji is not responsible for any acts, omissions, negligence, or misconduct of instructors providing services at the studio.
  • You recognise that Classes may require physical exertion and are aware of the risks and hazards involved. You will not exceed your personal exercise limits.
  • You acknowledge that you are physically fit and have no medical condition which should prevent your participation in a Class.
  • You assume full responsibility for using any equipment provided at any Goji studio. You further acknowledge that Reformer Pilates involves the use of spring-loaded moving equipment and carries additional risks including falls, strains, impact injuries, trapping injuries, loss of balance, and injuries arising from incorrect use of equipment.
  • You agree to follow all instructor guidance regarding safe use of reformer equipment at all times.
  • You acknowledge that classes may involve physical contact for posture adjustments and will inform instructors if you prefer otherwise.
  • Goji reserves the right to refuse participation in any Reformer Class where it reasonably believes participation may pose a health or safety risk.
  • If you are pregnant, you acknowledge participation at your own risk and that non-pre-natal classes may not be suitable for your condition.
  • You recognise that you will be sharing a room with other members of the public and potentially increasing the risk of contracting Covid-19 or other illnesses and are fully aware of this risk.
  • Goji does not provide medical advice or treatment.
  • In the event of a medical emergency, you authorise Goji to seek emergency assistance on your behalf and accept responsibility for any associated costs.
  • You waive any claims against Goji for injury, loss, or damages arising from participation, to the fullest extent permitted by law.
  • Use of the Infrared Sauna is entirely voluntary and at your own risk.
  • You acknowledge that exposure to heat may carry risks including dehydration, dizziness, fainting, overheating, burns, aggravation of medical conditions, cardiovascular stress, low blood pressure, and other adverse reactions.
  • You confirm that you will not use the Infrared Sauna if you are pregnant, under the influence of drugs or alcohol, have been advised against heat exposure by a medical professional, or suffer from any medical condition that may make sauna use unsafe.
  • You agree to leave the Infrared Sauna immediately if you feel unwell, dizzy, nauseous, overheated or uncomfortable.
  • You agree to disclose any injuries, medical conditions, symptoms, physical limitations or other concerns which may affect your participation in Classes or use of Facilities.
  • You acknowledge that Goji relies on the information you provide regarding your health and physical condition.

4. Liability Disclaimer

  • Goji does not provide medical treatment or emergency medical services.
  • Goji is not responsible for any injury or harm caused by independent contractors providing services at its premises.
  • You release Goji, its owners, directors, agents and instructors from any and all claims, liabilities, demands, actions, or causes of action arising out of, or related to, your participation in mat Pilates, Reformer Pilates, yoga, infrared sauna, or any other activity offered by the studio.
  • You agree to indemnify and hold harmless Goji, its owners, directors, agents and instructors, from any claims or liabilities to the fullest extent permitted by law.
  • Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability which cannot legally be excluded under English law.

5. Right of Admission

Goji reserves the right to refuse entry or remove any individual whose conduct disrupts classes or breaches these Terms and Conditions, or if it would otherwise be in the interests of other clients.

6. Packages (Membership & Class Packs)

  • Class Packs and Memberships are non-refundable, non-transferable, and must be used within the expiry period.
  • Class Packs activate from the date of purchase. Expiry terms for each class can be viewed on our website. It is your responsibility to use your class pack within the required timeframe.
  • Class packs are valid for use by named pass holders only.
  • Memberships are rolling monthly contracts unless otherwise agreed in writing.
  • A minimum 14-day notice is required for membership cancellations.
  • Memberships can be paused (“frozen”) upon request, up to the following limits:
    • Mini Memberships – up to 2 weeks’ total each year
    • Standard Memberships – up to 8 weeks’ total each year
  • Packages may be:
    • Studio-specific, or
    • Valid across multiple Goji studios (as stated).
  • It is your responsibility to check that your bookings align with your Package type.
  • Clients booking through third-party platforms remain subject to these Terms and Conditions in addition to the terms of the relevant third-party platform.
  • Certain services, facilities, benefits or amenities may be restricted to direct Goji clients and Members only.

7. Studio Policies

  • Late Arrivals: If you are late, you may not be permitted entry to class. This is for the safety of you and other attendees, and also protects the class environment and experience for everyone.
  • Cancellations & No-Shows: We have a strict cancellation policy in place to protect class planning and the group environment. If you do not cancel before the cancellation window (as defined here), your class credit will be forfeited. This is defined as a “late-cancel”.
  • If you are a monthly member, you will be subject to a penalty of £10per late cancellation if you late-cancel more than once in a month.
  • If you miss a class without cancelling, a ‘No Show’ fee of £10will be charged.
  • Valuables: Storage facilities vary by location. Goji is not responsible for loss or damage to personal belongings. All personal belongings are brought into the Studio entirely at the owner’s risk. Goji accepts no responsibility for theft, loss or damage to personal property except where caused by Goji’s negligence and where liability cannot legally be excluded.
  • Check in: The studio requires that you sign into class prior to the class start time. It is your responsibility to ensure your attendance has been registered by the instructor. Failing to do so may mean you are recorded as a no-show.
  • Multi-Site Use: when attending different Goji studios, you agree to comply with the specific operational policies and etiquette of each site, including available facilities, timings, and amenities.
  • Facilities & Additional Services: Where applicable (e.g. sauna, showers, changing facilities):
    • Use is at your own risk.
    • You must follow all safety guidance provided in-studio.
    • Goji reserves the right to restrict access where necessary.
  • Minimum Age: unless otherwise expressly stated, clients must be aged 18 or over to attend classes or use Facilities, including the Infrared Sauna.
  • Grip socks are mandatory for all Reformer Classes. Clients without appropriate grip socks may be refused entry to class.
  • Towels may be required for certain services or Facilities. Additional charges may apply for towel hire or replacement.
  • Certain Facilities or areas may be reserved exclusively for specific membership tiers, package holders or direct Goji clients over and above third party clients. Access rights may vary by Studio location, booking type, or membership category.

8. Payment & Pricing

  • Payments are processed online only. Payments are not accepted in studio.
  • Pricing and service availability may change at any time. Any changes affecting direct debit customers will be notified of any changes in advance.
  • By providing payment details, you authorise Goji to charge the card provided by you without prior notice. These authorised charges may include, but are not limited to, bookings, fees for late cancellations, missed classes, penalties associated with monthly memberships, or any misuse of promotional offers, such as the Intro Offer, which is strictly reserved for first-time clients. Any attempt to circumvent offer restrictions, including creating duplicate accounts or engaging in other fraudulent activity, will result in corrective charges to your card on file, and potential suspension of access to Goji services.

9. Promotions & Gift Cards

  • Goji reserves the right to run promotional discounts and sale offers that may be varied at any point from time to time.
  • Promotional discounts cannot be combined or backdated.
  • Corporate discounts can be provided on request. For further information, contact us directly.
  • Gift cards are valid for 6 months unless otherwise agreed in writing with the studio.
  • Gift cards cannot be exchanged for cash, nor can any balances remaining be refunded.

10. Privacy & Data Protection

  • We collect and store data to provide services and manage accounts.
  • Data security measures are in place, but transmission risks exist. As with all information transmitted over the internet, security cannot be guaranteed. Any transmission is at your own risk. Once we have received your information, we will take reasonable precautions to prevent unauthorised access.
  • If you contact us, we may keep a record of our correspondence, including but not limited to when you report a problem with the Website or the Momence App, provide feedback regarding any of our services, or apply for a job or volunteer position at Goji.
  • Clients can amend or delete their data by contacting hello@gojilondon.co.uk.

11. Independent Contractors

  • All instructors, therapists, practitioners and certain service providers engaged at Goji operate as independent self-employed contractors unless otherwise stated.
  • Such individuals are responsible for maintaining their own qualifications, insurance and professional registrations where applicable.
  • To the fullest extent permitted by law, Goji shall not be liable for the acts, omissions, negligence or misconduct of independent contractors operating at or through the Studio.

12. Studio Etiquette & Filming

  • Clients must behave respectfully towards instructors, staff and other clients at all times.
  • Goji reserves the right to prohibit filming, photography or disruptive use of mobile devices within Studio spaces.

13. Intellectual Property Rights

  • You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
  • You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
  • You grant to us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use (including but not limited to publishing, exploiting and modifying) any material you email, post or submit to us. For the avoidance of doubt, we will be free to use any ideas, concepts, know-how, content, text or images contained in your communications with us for any purpose whatsoever, to the fullest extent permitted by law.

14. Website Terms & Conditions

  • Indemnity: You fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person
    accessing the Website using your shopping account and/or your Personal Information.
  • We reserve the right to:
    • Modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
    • Change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions, then you must immediately stop using the Website.
  • Compliance with laws: The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.
  • Limitation of Liability:
    • While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from a course of dealing or usage or trade.
    • We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available is free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
    • To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
    • We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in
      connection with the Conditions for: Any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
    • Any loss of goodwill or reputation; or
    • Any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.
    • Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

15. Severance

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

16. Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

17. Governing Law

These Terms and Conditions are governed by English law, and disputes shall be settled in English courts.

  • Amendments to Policies, Terms & Conditions: We reserve the right to update or amend these Policies, Terms & Conditions at any time to reflect changes in our services, policies, or operations. Where material changes are made, we will make reasonable efforts to notify clients. However, it remains your responsibility to review and stay up to date with the current version of our Terms & Conditions, which will always be available via our website and/or booking platform emails.
